An Army veteran who fired a gun twice into the air and hit no one is facing a jail sentence of up to 120 years.

Florida resident Randal Ratledge, 68, threatened his neighbors and fired two shots into the air in 2012, and his case is finally going in front of a jury . According to Ratledge’s lawyer, he was suffering a bad reaction to his new sleep medication Ambien, and thus had no control over his actions. Though Ambien does has a reputation for causing hallucinations and bizarre behavior, it’s up to a jury to decide whether Ratledge’s story holds any water.

However, the jury’s decision may condemn the Army veteran to more than 100 years in prison. According to the Florida’s 10-20-Life law, anyone convicted of a crime connecting to firing a gun gets a minimum 20 year sentence. Ratledge was charged with six counts of aggravated assault, one count for each neighbor. Do the math and you have a minimum 20-year sentence and a maximum 120-year sentence. Yikes.

“The problem with our system now is judges have no discretion,” defense attorney Bill Sheppard said. “Prosecutors decide the sentence, not judges.”

Ratledge’s lawyer that he could get away with an 18-year sentence if he makes a deal with the prosecution, but at Ratledge’s age that is basically a life sentence anyway.
